  • GENERAL PROVISIONS

 

  1. These Regulations set forth the general terms and conditions, rules and manner of providing Services electronically, through the swiper.site website (hereinafter referred to as , "Website" or , "Service").
  2. The Website has the character of a platform for purchasing Tickets for various types of Events, especially entertainment, sports, music, cultural or other events, according to the information on the Website. The seller of the Tickets is the Service Provider, while the events are organized and conducted by the Organizers indicated on the Site.
  3. The Website is operated by Michal Bronk, doing business under the name LIMEJUICE MICHAŁ BRONK.

  1. These Terms and Conditions are continuously made available free of charge by the Service Provider on the swiper.site, in a manner that allows Users to obtain, reproduce and record their content by printing or saving on a medium at any time through the computer system used by the User.
  2. All rights to the Website, including property copyrights, intellectual property rights to its name, Internet domain, Website, as well as to the forms, logos belong to the Service Provider, and use may only be made in the manner specified and in accordance with the Regulations.
  3. The Service Provider reserves the right to post advertising content on the Website regarding the services offered, as well as goods and services of third parties, in the forms used on the Internet. The use of such offers or services is not part of the Website, and their rules are determined by the relevant third parties.
  4. These Regulations set forth, in particular, the rules for the use of the Website, the types and scope of the Services, the conditions for providing the Services, the conditions for concluding and terminating agreements for the provision of the Services and the procedure for complaints.
  5. The Service Provider informs that the use of Services provided electronically may involve risks on the part of each Internet User, consisting of the possibility of introducing harmful software into the User's computer system and obtaining and modifying his/her data by unauthorized persons. To avoid the risk of the aforementioned threats, the User should use appropriate technical measures to minimize their occurrence, in particular, antivirus programs and firewall.
  6. The rules of providing other Services on the Site, including paid Services, may be specified in additional regulations. The conditions and manner of providing Services to Organizers, as well as the principles of the Service Provider's cooperation with Organizers, are governed by separate regulations or agreements.

 

  • DEFINITIONS

 

The terms used in this document have the following meanings:

 

Service Provider - Michał Bronk, conducting business under the name LIMEJUICE MICHAŁ BRONK entered in the Register of Entrepreneurs of the Central Registration and Information on Business Activity conducted by the Minister responsible for economy, at 100/6 Grunwaldzka Avenue, 80-244 Gdańsk, NIP 9570664894, REGON 221083555;

 

User - a natural person with full legal capacity, a natural person conducting business, a legal person or an organizational unit without legal personality that can use the Services available on the Site;

 

Consumer - a User who is a consumer within the meaning of Article 22[1] of the Civil Code of Poland;

 

Entrepreneur - a User of the Website who is an entrepreneur within the meaning of Article 43[1] of the Civil Code od Poland;

 

Customer - a User who orders a Ticket on the Website;

 

Account - a part of the Service assigned to a given User, by means of which he/she can perform certain actions within the Service. An Account in the Service may also have an Organizer. The Account of a User who is not an Organizer and the Account of an Organizer may differ in the functionalities assigned to these Accounts. The Organizer's Account is established and maintained under the terms and conditions set forth in separate regulations;

 

Event - an event of entertainment, sports, music, cultural or other nature, organized by the Organizer, the description of which is each time presented by the Organizer in the description of such Event on the pages of the Website;

 

Ticket - a document available for sale on the Site, either a bearer document or a named document depending on its type, in particular containing a combination of unique characters and/or information about a particular Event. Subject to the provisions of these Rules and Regulations, a Ticket entitles the holder to participate in a specific Event, carried out by a designated Organizer, in accordance with the information available in the description of that Event and other information presented on the Site;

 

Organizer - Third Party Entrepreneur organizing or executing an Event and presenting on the Website information regarding the Events it organizes;

 

Order - the User's declaration of intent, aiming directly at the purchase of a Ticket offered for sale by the Service Provider and entitling the User to participate in the Organizer's Event, under the terms and conditions independently determined by that Organizer;

 

Contract/Contract of Sale - a contract for the sale of a Ticket within the meaning of the Civil Code, concluded between the Service Provider and the User, under the terms of these Regulations;

Service Agreement - a contract concluded by the User with the Service Provider covering the implementation of the Service on the Site;

 

Services - services provided by the Service Provider to Users electronically, as defined in the Act on Provision of Electronic Services;

 

Consumer Rights Act - the Act of May 30, 2014 on consumer rights (Journal of Laws 2014, No. 827);

 

Electronic Services Act - the Act of July 18, 2002 on the provision of electronic services (Journal of Laws No. 144, item 1204, as amended);

 

Civil Code - the law of April 23, 1964 (Journal of Laws No. 16, item 93, as amended);

 

Regulations - this document.


 

  • TERMS OF USE

 

  1. The Service Provider on the Site allows Users to use the Services it provides, in particular the possibility to place Orders for Tickets presented on the Site, as well as to use other Services available on the Site.
  2. The use of the Service is made on the terms and to the extent indicated in the Regulations.
  3. Minimum technical requirements to use the Service:

 

  • device with Internet access,
  • email access,
  • The latest version of your web browser with Cookies and Java Script enabled,
  • A program to read and write PDF files.

 

  1. It is forbidden for Users to use the Site or Services in a manner that violates the law, morality, personal rights of third parties or the legitimate interests of the Service Provider.


 

  • SERVICES


 

  1. The Service Provider provides paid and unpaid Services to the Users, in accordance with the information presented on the Website and under the terms indicated in these Regulations.
  2. The Service Provider, through the Website, allows Users to use the following Services:
  • Browse and search for information posted on the Website, including information about Services provided by the Service Provider and information presented by the Organizers themselves, as well as information of an advertising or marketing nature;

 

  • Establishing and maintaining an Account on the Website;
  • providing an interactive form that allows Users to place an Order.
  1. Placing an Order is subject to a fee, in the amount indicated in the description of the Ticket. The other Services indicated in subsection 2 above are Free Services.
  2. Each User of the Website has the ability to browse and search for information presented on the Website, including information about Events presented by the Organizers themselves.
  3. The contract for the provision of the Service consisting of browsing and searching for information available on the Website is concluded for a definite period of time and is terminated when the User closes the Website.
  4. Use of certain Services of the Website requires registration and having an active Account. The Service Provider provides Users with the opportunity to register an Account on the Site. The rules of providing the Service of establishing and maintaining an Account on the Website are indicated in sec. V of the Regulations. The possibility of establishing and maintaining an Organizer Account is regulated by separate regulations.
  5. Provision of the Service, which consists in providing an interactive form that allows Users to place an Order, is concluded for a definite period of time, under the terms indicated in point. VI of these Regulations
  6. The Service Provider has the right to organize occasional contests and promotions, the terms of which will be stated each time on the Website. Promotions on the Site are not cumulative, unless the Terms and Conditions of a given promotion state otherwise.

 

  • ACCOUNT

 

  1. The service of maintaining an Account on the Website is available after registration. Registration of an Account takes place by the User completing and accepting the registration form, made available on the Service.  In order to correctly complete the registration, the User may also be asked to perform additional activation of the Account, including by e-mail, according to the information displayed on the Service.
  2. When filling in the fields of the registration form, the User is obliged to provide data marked as mandatory, including, in particular, his e-mail address.
  3. By registering an Account, you declare that the data you provide in the registration form is true and does not violate the rights of third parties.
  4. The User is obliged to enter data on the Site in accordance with the actual state of affairs and to inform immediately about any changes in the data provided to the Service Provider.
  5. Actions aimed at setting up an Account, as well as other actions under the provided Account Service, may be performed only by persons duly authorized to act on behalf of the User who is an Entrepreneur.
  6. A User may not have more than one Account assigned to one e-mail address. The User is not allowed to use the Accounts of other Users and provide others with the possibility of using the Account, including disclosure of the password to access the Account.
  7. Viewing some of the content presented on the Website and using some of the functionalities available on the Website, such as access to the Order history on the Website, may require the User to create an Account and log in to it.
  8. The contract for the provision of the Service consisting in maintaining an Account on the Website is concluded for an indefinite period of time and is terminated when the registered User sends a request to delete the Account.

 

  • TICKET SALES

 

  1. The Service Provider sells Tickets for Events organized by the Organizers through the Website.
  2. Tickets allow you to participate in Events in accordance with the information presented on the Website, including primarily those contained in the description of each Event.
  3. The seller of Tickets is the Service Provider. The Organizer of the Event is the Organizer indicated each time in the description of the Event.
  4. The Service Provider informs in the descriptions of Tickets on the pages of the Website about the available types of Tickets and the terms and conditions specified by the Organizer under which a particular Ticket may be used, including the rules of participation in the Event.
  5. In the event that the Service Provider uses mechanisms for individual price adjustment based on automated decision-making, it shall provide this information to the Consumer in each case, when placing an Order, taking into account the requirements imposed in this regard by data protection legislation.
  6. Various categories of Events may be presented on the Website, including sports, cultural, musical and entertainment events. The rules of participation are determined each time by the Event Organizer, but the Organizer may provide for restrictions on entry to the Event, in particular justified by the nature of the Event. Any such restrictions shall be included by the Organizer in the description of the Event and may also be available at the venue of the Event. The Customer is requested to read these rules before placing an Order.
  7. A Customer interested in purchasing a Ticket places an Order via the Order form available on the Website.
  8. The Order is placed by the Customer in electronic form and constitutes an offer to conclude a Contract of Sale for the Ticket. An offer made in electronic form binds the Customer if a confirmation of acceptance for execution of the Order is sent to the e-mail address provided by the Customer, which constitutes a statement of acceptance of the Customer's offer and upon its receipt by the Customer the Contract of Sale is concluded.
  9. In the Order form, the Customer selects the Ticket or Tickets he/she wishes to Order and, depending on the category of the Ticket, its other individual parameters, in particular the type, location or type of venue or additional services provided by the Organizer at the Event.
  10. On the Website pages, in the description of an Event or in the description of a Ticket, there is information about prices of Tickets, costs of their delivery and possible additional costs. Prices are given in Polish Zloty and include all components, including VAT, customs duties and other fees.
  11. The Customer shall pay for the Order by means of electronic payment integrated with the Service.
  12. Tickets are issued in electronic form, intended for self-printing by the customer.
  13. The Ticket is delivered to the Customer electronically, to the e-mail address indicated by the Customer during the Order placement process, in the form of a document in a PDF file. The Ticket is sent within 3 days after the Service Provider receives information from the billing agent's system about the Client's payment.
  14. The customer should protect the Ticket so received from damage, loss, as well as not to share it with third parties.
  15. The pages of the Site contain information on the deadline within which the Client is required to make payment for the Order. If the Client fails to make payment within the time limit referred to in the preceding sentence, the Service Provider, after an ineffective call for payment setting an appropriate time limit, may withdraw from the Sales Agreement on the basis of Article 491 of the Civil Code.

 

  • TICKETING RULES

 

  1. The Service Provider is not a contractor, co-constructor, organizer or commissioner of the conducted and organized Events, information about which is presented on the Website, unless otherwise indicated in the description of the Event. The Service Provider only offers, within the infrastructure of its Site, the possibility of purchasing a Ticket entitling one to participate in an Event, under the terms and conditions determined independently by its Organizer.
